Control of concentrations

August & Debouzy has developed broad experience in control of concentration procedures and represents investment funds or undertakings (quoted or unquoted companies) which, for the purpose of a merger transaction (merger, acquisition or joint venture), need to obtain the approval of the competent competition authorities in France, or at EU or international level (with the assistance of the members of its network).

We advise companies on the structuring of their transactions and act at all stages of the control of concentrations procedure: (i) analysis of the transaction, (ii) organisation of the notification timetable depending on the acquisition timetable and the stock market trading calendar (where applicable), (iii) initial contacts with the competition authorities, (iv) pre-notification and notification of the transaction, (v) representation of the notifying parties’ interests throughout the procedure (Phase I and possibly Phase II) and, (vi) if the decision is challenged, before the competent courts.

We also assist undertakings wishing to notify their opinion on concentrations between competitors and which may harm their interests.
