### (01) How does a law firm specializing in public procurement secure the award process?

Each procurement procedure involves significant economic interests and complex legal requirements regarding publicity, competitive tendering and selection. Since 1 January 2026, the threshold for formal procurement procedures stands at EUR 5,404,000 excluding VAT for works contracts and EUR 216,000 excluding VAT for supply and service contracts of local authorities (Annex 2 of the French Public Procurement Code). We cover the entire process: feasibility assessments, drafting tender documents, structuring applications, designing evaluation grids, advising during bid selection, negotiating contractual terms and assessing tax implications.

### (02) What legal support is required for public-private partnerships and public service concessions?

Public service concessions and public-private partnerships require deep technical expertise and long-term strategic vision. Article L. 2141-1 of the French Public Procurement Code provides for the mandatory exclusion of candidates convicted of certain offences for a period of five years from the date of conviction. We assist public bodies and private operators at each stage: risk matrix development, drafting consultation documents, conducting procurement procedures, negotiating terms and finalizing the contract. ### (03) How can a public procurement contract be amended during performance without a new competitive procedure?

Managing amendments and contractual modifications during contract performance is a critical issue for both public purchasers and contractors. Article L. 2194-1 of the French Public Procurement Code allows modifications without a new procedure in six exhaustively listed cases, including minor modifications (capped at 10% of the initial contract value for services and supplies, 15% for works). We assist clients in securing the legal framework of these modifications, assessing their substantive nature and preventing reclassification risks.
