### (01) How can you secure your IT contracts and manage disputes arising from technology projects?

Contractual failures in IT projects (system integration, software development, SaaS licences, outsourcing, cloud) generate disputes with significant financial and operational stakes. Delivery delays, functional non-compliance, service terminations, intellectual property disputes over developments: each technology project carries specific risks that must be anticipated contractually. We intervene upstream to structure IT contracts (SLAs, penalties, deliverable ownership, reversibility) and downstream to resolve disputes through negotiation, mediation, arbitration or court proceedings.

### (02) How can you ensure your data processing activities comply with the GDPR and manage CNIL investigations?

Every personal data processing operation engages the company’s liability. Regulation (EU) 2016/679 (GDPR) provides for administrative fines of up to EUR 20 million or 4% of worldwide annual turnover for the most serious violations. We advise companies on data governance: processing inventories, data protection impact assessments (DPIAs), international transfer frameworks, privacy policies and data breach management. In the event of a CNIL investigation, we manage responses to information requests, challenge formal notices and represent clients before the sanctions committee.

### (03) How can you anticipate AI Act obligations and new European digital regulations?

Regulation (EU) 2024/1689 on artificial intelligence (AI Act), in force since 1 August 2024, provides for fines of up to EUR 35 million or 7% of worldwide turnover for prohibited AI practices (applicable since 2 February 2025), and EUR 15 million or 3% for non-compliance with high-risk system obligations. DSA, DMA, NIS2, Data Act: European digital regulations establish a demanding framework requiring early compliance action. We assess our clients’ exposure under each regulation, design compliance frameworks and prepare companies for inspections by the competent authorities.

### (04) How should you respond to a cyberattack, data breach or cross-border digital dispute?

Digital incidents (cyberattacks, ransomware, data leaks, online fraud) require crisis management coordinating technical, legal and reputational dimensions. Under Article 33 of the GDPR, a data breach must be notified to the CNIL within 72 hours. We assist clients from the earliest hours: legal qualification of the incident, managing notifications to authorities and affected individuals, evidence preservation, filing complaints and coordinating with technical teams. We manage the resulting litigation before civil, criminal and administrative courts.
