August & Debouzy represent Ethical Coffee Company

One of the patents used by Nespresso in the capsule war, and disputed since 2010 by the capsule manufacturers, was revoked last Thursday by the Board of Appeal of the European Patent Office (EPO) in Munich. Such decision is effective in the whole of Europe.

 

The EPO, which had granted the patent in the first instance, has gone back on its ruling and revoked the European patent: thus, the patent is deemed to have never been effective. 

 

Ethical Coffee Company (ECC) was represented the attorneys Renaud Fulconis, industrial property counsel, and Grégoire Desrousseaux, partner, at August & Debouzy. 

 

This ruling will certainly have consequences on the different lawsuits initiated by Nespresso against the capsule manufacturers in different European countries (Germany, England, France, Belgium, The Netherlands, Italy and Spain).
