Fraude fiscale et blanchiment : les précisions de la Cour de Cassation (1/5)
Le 11 septembre 2019, la Chambre criminelle de la Cour de cassation a rendu six arrêts de principe (n° 1174 à 1179) sur la répression des délits de fraude fiscale et de blanchiment à la lumière des jurisprudences constitutionnelles et européennes. Des précisions importantes sont ainsi apportées sur le cumul des sanctions pénales et fiscales, les modalités d’application des réserves d’interprétation émises par le Conseil constitutionnel (autorité de la chose jugée du fiscal sur le pénal, gravité des faits et proportionnalité des peines) et la répression du délit de blanchiment. Ces arrêts sont d’autant plus importants qu’ils interviennent dans un contexte de montée en puissance des poursuites pénales en matière de fraude fiscale depuis l’entrée en vigueur de la « loi Fraude » (loi n° 2018-898 du 23 octobre 2018). Alors que nous vous informions cet été de l’adoption par le Sénat du projet de loi relatif à la lutte contre la fraude, celui-ci a été modifié le 26 septembre 2018 par l’Assemblée nationale. Il revenait donc à une commission mixte paritaire de proposer une version commune aux deux chambres. C’est ainsi qu’au terme de ce processus législatif la loi n° 2018-898 du 23 octobre 2018 relative à la lutte contre la fraude entre en vigueur aujourd’hui. Focus sur les mesures phares de cette réforme attendue qui accroît les prérogatives de l’autorité judiciaire en matière de lutte contre la fraude fiscale.
