NPE litigation: is Europe the new Eldorado?
Non Practicing Entities (NPE), sometimes also called Patent Assertion Entities (PAE), are much more active in Europe, in particular in Germany and United-Kingdom but also in France which is new.
NPEs can cover very different business models but litigation is the key factor of their strategy. NPEs in general are very controversial. Targets consider they have a negative impact on innovation, imposing additional costs to innovation, while NPEs consider they foster innovation by increasing the liquidity of the patent market.
NPEs are mainly US centric companies but NPEs also appeared in Europe. Darts-ip platform, which collected millions of court documents, published a study in February 2018 about NPE activity in Europe. This study, ‘’NPE Litigation in the European Union, Facts and Figures, February 2018’’, shows that the NPE activity increased from 2007 to 2016. What is the situation today? Are NPEs still very active and what can be expected going forward? Darts-ip team, which has carried on the effort to collect the information about NPE activity in Europe, has accepted to present during this breakfast session the most recent developments of NPE litigation activity in Europe and in particular in France.
